5. Job Candidate Privacy Notice

  • Personal Data Processed for Candidates
  • If applying for a job with Agile, additional data related to candidacy may be collected:
    1. Contact information, address, and personal details
    2. Resume, skills, education, work history, references, and additional career-related or personal information
    3. Notes submitted with applications
    4. URL of LinkedIn and other online profiles
    5. Position for which consideration is being given
    6. Source who submitted candidacy (e.g., recruiting agency, referral)
    7. Email correspondences between candidate, Agile, and other sources about candidacy
    8. Information from references
    9. Events in the lifecycle of candidacy
    10. Responses to questionnaires
    11. Information about candidacy and employment options (such as availability and salary expectations)
    12. Evaluations of candidacy
    13. Internal discussions within Agile about candidacy
    14. Materials submitted by candidate or other parties (such as evaluators or background check providers)
    15. Interview recordings (via Spark Hire, Zoom, Microsoft Teams, OBS Studio, or other video conferencing and recording software)
    16. Communication history related to application
    17. Background checks or references (where applicable)
  • Personal data can originate from the candidate directly or from other sources, such as LinkedIn profiles, recruitment agencies, headhunters, and referrals.

Hiring Platform: Spark Hire (formerly Comeet)

Spark Hire is used for video interviews, application tracking, and evaluation workflows. Data submitted through Spark Hire is processed according to their Privacy Policy.

Other Platforms

If hired, additional personal data may be processed via Paylocity (HR and payroll) and stored securely using Dropbox, SharePoint, and other internal or networked platforms and solutions.

Data Retention for Candidates

Candidate information is accessible only to authorized hiring personnel and is retained as needed to complete the hiring process or comply with legal requirements. Candidate data may be retained to consider future opportunities, unless deletion is requested. Personal data is retained for as long as needed to assess candidacy or as long as a valid legal basis exists. In accordance with internal data retention policies and practices, decisions are made whether to keep personal data, delete it, or pseudonymize/anonymize it.

Sharing Candidate Data

Personal data may be shared with:

  • Service providers and vendors who assist in collecting, processing, and storing personal data
  • Affiliated corporate group entities
  • Third parties who submitted candidacy to Agile (general recruitment status)
  • Third parties who provided referral links (some general recruitment status without identifying by name)
  • Judicial, governmental, and regulatory authorities when required by law
  • Third parties in connection with business transfers, mergers, acquisitions, or bankruptcy proceedings

6. Third-Party Vendors

Personal data is shared only with service providers who support Agile operations and are contractually bound to protect information. These may include:

  • Spark Hire/Comeet – candidate management and video interviews
  • Paylocity – employee onboarding, payroll, and HR services
  • Dropbox – file storage and collaboration
  • SharePoint – file storage and collaboration
  • Google Analytics – anonymous website analytics

These vendors are not authorized to sell, reuse, or share data for their own purposes.

 

7. Data Retention and Security

Personal information is retained only as long as needed to fulfill the purposes described above, or as required by applicable law. When data is no longer needed, it is securely deleted or anonymized.

 

Agile Group uses industry-standard technical and organizational safeguards to protect data from unauthorized access, alteration, or loss. However, no system can guarantee absolute security.

8. International Data Transfers

Agile Group and vendors may process data in the United States or other countries with appropriate safeguards in place. Personal data is hosted in connection with platform use either in the European Economic Area, in the US, in the country where Agile is located, or in countries deemed as providing an adequate level of data protection. Data will be accessible in the country where Agile or service providers are located, the UK, the US, and countries deemed as providing an adequate level of data protection. Legally recognized transfer mechanisms (e.g., standard contractual clauses) are used to protect data across borders.

9. Rights and Choices

Depending on jurisdiction, rights may include:

  • Correct or update inaccurate information
  • Request deletion of data
  • Restrict or object to certain types of processing
  • Withdraw consent (where applicable)
